区块链技术两面性分析——法律和金融视角

The Dual Character of Blockchain:Thoughts of Legal and Financial Perspectives

习近平总书记在中央政治局集体学习时关于区块链技术的重要论断为积极稳妥推动这一技术发展指明了方向。重大技术革新往往正面效应与潜在负面效应并存。与人工智能等热门技术相比,区块链技术有共性也有个性。共性体现在国家重视程度高、发展规模失衡、基础研究弱、未来前景乐观4个方面;个性体现在共识机制、去中心化点对点系统和哈希算法3个方面。这些特点导致区块链技术的两面性集中于法律和金融领域,表现为区块链经济带来的法律新问题和区块链金融引起的创造性毁灭(creative destruction)。因此,应全面客观看待区块链技术的两面性,既积极乐观,又审慎理性。

Technology innovation is always a double-edged blade,which has positive and negative effects.By comparing to artificial intelligence or other new technologies,it is generally accepted that blockchain is similar to these innovations to some extent.These technologies are with similar characteristics e.g,hot-spot,lack of scale and R&D,and alluring prospects.Furthermore,the unique characteristics of blockchain are decentralized,verifiable and unalterable.These characteristics are viewed as having many advantages within the logistics industry.As mentioned earlier,it is a double-edged sword,which also harms society.It lacks governance and it causes creative destruction that we need to evaluate blockchain objectively.
