摘要
采用法释义学方法解读亚洲基础设施投资银行修订的《环境与社会保障政策框架》及其实施指令,发现:其申诉与问责机制在涉案裁判边域范围方面亟待拓宽;涉环境问题案件的责任归属不明,导致未达环境标准的投资主体无法从权利本位向责任本位转变;在申诉与问责机制的法律适用方面,缺少可遵循的评判原则及程序规则,减损了以私法化方式解决涉环境问题投资争议的法律价值。建议从以下方面完善亚洲基础设施投资银行涉环境问题投资争议的申诉与问责机制:在既有的法律框架下,从公众参与和环境人权保护的角度完善利益受损主体的救济方式,增设监察组和独立的申诉与问责机构,并制定涉环境问题不予贷款的规则。
Using the method of law hermeneutics to interpret the Asian Infrastructure Investment Bank’s revised Environmental and Social Security Policy Framework and its implementation directives,we found that: its appeal and accountability mechanism urgently needs to be expanded in the scope of the jurisdiction of the involved judges;the attribution of environmental responsibility cases was unclear,this led to investment entities that have not met environmental standards unable to change from rights-based to responsibility-based;in regard to the legal application of the complaint and accountability mechanism,lack of followable judgement principles and procedural rules,decreased the legal value of using private law to resolve investment disputes related to environmental issues. It is recommended to improve the appeal and accountability mechanism for investment disputes involving environmental issues of the Asian Infrastructure Investment Bank from the following aspects: under the current legal framework,from the perspective of public participation and the protection of environmental human rights,improve the remedy of the party whose interests are damaged,and establish the monitoring team and independent complaint and accountability institutions,additionally make rules of non-loans for environmental issues.
