新型就业形态下的劳动标准探析与建构 被引量:2

摘要 基于“网络平台”的工作已成为近年来广受关注的劳动力市场发展趋势之一,形成了依托信息技术实现劳动力供给与需求实时匹配的新型就业形态。在新型就业中,劳动者实时工作实时获得报酬,劳动的雇用主体被虚化,网络平台以经济手段管理劳动者。由于网络平台依照民事合同提供格式化服务条款,在司法实践中平台与劳动者之间往往被认定不存在劳动关系,导致新型就业劳动者无法获得法律上的权益保障。在现有劳动法律制度中,构建适合新型就业形态的劳动标准体系,可以为破解这一难题提供解决方案,在平台用工成本与劳动者权益之间取得平衡,维护劳动力市场的正常秩序。 The work based on the"network platform"has become one of the development trends of the labor market which has wide concern in recent years,forming a new type of employment pattern that relies on information technology to realize the real-time matching of labor supply and demand.In the new type of employment,workers get real-time remuneration for real-time work,the main body of employment is virtualized,and the network platform manages workers by economic means.In the judicial practice,the platform and the workers are often found to have no labor relationship,because the network platform provides the formatted service terms according to the civil contract,so that the new type of employment workers cannot get legal protection of rights and interests.In the existing system of labor laws and regulations,the construction of a labor standard system suitable for new forms of employment can provide solutions to this problem,which can help to achieve a balance between the platform labor cost and the rights and interests of workers,and maintain the normal order of the labor market.
