智能裁判的科学内涵

Scientific Connotation of Intelligent Judgment

司法裁判自“神明裁判”起始,在经历“法官裁判”漫长实践之后,如今步入“智能裁判”的新时代。当下学界或将智能裁判定义为对传统司法裁判的模仿,或视智能裁判为“高级司法人工智能”,将“初级司法人工智能”仅认定为一种司法辅助工具,排除在智能裁判的定义之外。智能裁判是智能科技与司法实践演进的逻辑必然,应从裁判主体、裁判客体以及主客体关系等层面精准厘定其科学内涵。

Starting with“divine judgment”,judicial judgment,after long practices of“judge adjudication”,enters a new era of“intelligent judgment”.At present,the academic circles either define the intelligent judgment as the imitation of the traditional judicial judgment,or regard it as the“advanced judicial artificial intelligence”,recognizing“primary judicial artificial intelligence”as a judicial auxiliary tool excluded from the definition of the intelligent judgment.However,intelligent judgment is logically inevitable in the evolution of intelligent science and technology and judicial practice,which should be given precise scientific connotation from the aspects of the subject of the intelligent judgment,the object of the intelligent judgment and the relationship between the subject and the object.
