从“神判”到“智判”:论司法审判方式的嬗变

From“Divine Judgment”to“Intelligent Judgment”:On the Evolution of Judicial Judgment

审判是正义得以实现的程序,从“神判”走向“人判”,并逐步发展成一套完整的规则体系沿用至今。随着互联网、大数据、云计算等技术的发展,传统的审判方式再一次迎来变革,出现了以人工智能为重要司法辅助工具的“智判”模式,这种模式更具备形式上的理性,同时也存在隐忧。司法审判方式有一个嬗变的过程,应当从历史的视角探寻其中的规律,为发展智能裁判提供依据。

As the procedure to realize justice,judgment has changed from“divine judgment”to“human judgment”,and gradually developed into a complete set of rules that have been used up to now.With the development of internet,big data,cloud computing and other technologies,the traditional judgment mode once again ushered in a change.The so-called“intelligent judgment”mode,which takes“artificial intelligence”as an important judicial assistant tool,has emerged.This mode is more rational in form,but also has hidden worries.With a process of evolution,judicial judgment has its law of change and development,which should be explored from a historical perspective to provide a basis for the development of intelligent judgment.
