法律服务视阙下企业参与“一带一路”建设的法律保障策略

The Law Guarantee Strategy of the Enterprise’s Participation in the"One Belt and One Road"Construction under the View of the Legal Service

在国际国内环境的双重影响下,中国企业"走出去"已然成为国家细化"一带一路"建设的亮丽风景线。在取得丰硕成果的同时,东道国日益提高的投资要求以及复杂的营商环境,给企业"走出去"参与推进"一带一路"建设带来了更为复杂的风险和问题,也进一步要求我国各部门与企业联手共同应对碎片化保障机制所增加的适用难度。本文从分析这些风险和问题的基础上,试图围绕政策、资金和本地化三方面的法律风险,从法律服务视角提出一些有建设性的意见和建议,阐述如何出海保障企业参与"一带一路"建设。

Under the double influence of the international domestic environment,Chinese corporations’"Get out of China"has become the beautiful scenery line of the national refined"One Belt and One Road"construction.In these years,our country has got fruitful results,at the same time,the increasing investment requirements of the host country and the complex business environment of the host country have brought more complex risks and problems to the corporations that get out of China to participate in the construction of the"One Belt and One Road".It also further requires that our departments and enterprises work together to deal with the application difficulty of the fragmentation safeguard system.Based on the analysis of these risks and problems,this paper tries to put forward some constructive advice and suggestions from the perspective of legal service around the legal risks of policy,capital and localization,and expounds how to go to sea to ensure the participation of enterprises in the construction of"Belt and Road Initiative".
