碳排放权交易的监管主体之比较研究及对我国的启示

Comparative Study on Regulatory Body of Carbon Emission Right Trading and Its Inspiration for China

碳排放权交易制度主要包括交易制度与监管制度。在监管制度中,监管主体设置的合法性与合理性将直接影响制度整体是否能够发挥预期的作用。通过考察英国、欧盟、美国的碳排放权交易监管主体的设置及其历史沿革可以发现其行政权设置的合法性与合理性基础,值得我国在碳排放权交易监管主体设置上借鉴。我国碳排放权交易监管主体的设置有其自身的合法性与合理性根据,但仍存在进一步改革与优化的必要性。在改革的方向上,应当合理区分宏观监管与微观监管,同时充分发挥非政府组织或者公共组织在监管上的积极作用。

The system of Carbon Emission Right Trading mainly consists of trading system and governance system,and on the aspect of governance system,the legitimacy and rationality of setting up the governance body would affect directly the expected function of the integrate system.Through the arrangements of governance and its history in UK,EU and USA,it is found out that the legitimacy and rationality of such arrangements is worth for reference to the arrangement of governance body in China.The is a certain foundation of the legitimacy and rationality of the arrangement of governance body in China,however this is also an necessity for further reforming and optimizing.The direction of the reforming is to classify the macro governance and micro governance,and take advantage of the positive function of non-government body or public organization.
