论我国可撤销婚姻和无效婚姻制度的完善——以特殊群体婚姻效力为分析对象

On the perfection of the system of revocable marriage and invalid marriage in China——Taking the marriage effectiveness of special groups as the analysis object

随着社会的发展和人们婚姻家庭观念的转变,我国现行《婚姻法》中关于可撤销婚姻和无效婚姻制度的规定呈现出一定的滞后性。二者的范围、界限以及宣告程序等均不能很好地适应现实社会中出现的新情况,不但难以保护婚姻当事人的合法权益,还损害了我国法律的公正性。因此,适当扩大可撤销婚姻和无效婚姻的范围,厘清二者之间的界限,并将一些特殊群体的婚姻效力问题纳入立法考量的范围,构建更加合理的可撤销婚姻和无效婚姻制度体系,是推动我国婚姻家庭法治建设、维护公民合法权益的必经之路。

With the development of society and the change of people’s concept of marriage and family,the provisions on the system of revocable marriage and invalid marriage in China’s current“Marriage Law”show a certain lag.The scope,limits and declaration procedures of the two cannot adapt well to the new situation in the real society.Not only is it difficult to protect the legitimate rights and interests of the marriage parties,but also damages the fairness of China’s laws.Therefore,it is the only way to promote the construction of the rule of law in marriage and family in China and safeguard the legitimate rights and interests of citizens by appropriate expanding the scope of revocable marriages and invalid marriages,clarifying the boundary between the two,and incorporating the marriage effectiveness of some special groups into the scope of legislative considerations to build a more reasonable system of revocable marriages and invalid marriages.
