检察机关在防范化解民营企业法律风险的功能定位,总的来讲,着手发挥打击、预防、监督、教育、保护等检察职能,并基于原则做出有价值偏向的自由裁量,弹性而有效地在其自身规范职责内为民营企业创新创业创造良好的法治环境。司法实践中,检察机关在保护民营企业方面存在司法能力建设不足、理念局限导致作为偏向等问题,未能较好地发挥其功能价值。对此,需要加以改进优化完善,契合检察机关在防范化解民营企业法律风险的功能定位。

In general,the procuratorial organs'functional orientation in preventing and resolving private enterprises'legal risks includes giving play to the procuratorial functions of strike,prevention,supervision,education and protection,making value-oriented discretion based on the principles,and flexibly and effectively creating a good lawbased environment for private enterprises within the scope of their statutory duties.In judicial practice,the procuratorial organs haven't given full play to the value of these functions due to insufficient efforts maded in improving the judicial capacity for protecting private enterprises,and the deviation caused by limitations of idea in practice.In this regard,we need to improve and optimize procuratorial organs'functions in line with the functional orientation of preventing and resolving private enterprises'legal risks.
