建筑类院校模拟法庭实训课程的困境及其优化路径

摘要 建筑类院校法学专业的培养目标系培养建筑工程领域内的交叉性、应用性法律人才。模拟法庭实训课程是以仿真审判为主要内容的实践教学课程。当前建筑类院校模拟法庭实训课程设置上存在教学内容趋同化、教学主体专业背景单一、教学设置不合理等困境。基于建筑类院校法学专业目标培养标定位,其模拟法庭实训课程的主要出路在于:精选案例,以建筑工程类法律纠纷案例为主;加强师资培训,拓展教师知识结构;优化模拟法庭的课程设计等。 The training objective of the law major in architecture colleges is to train the talents of the intersection and application of law in the field of construction engineering.Moot court training course is a kind of practical teaching activity which takes moot trial as the main content.At present,there are some difficulties in the practical training courses of moot court in architectural colleges,such as the assimilation of teaching content,the simplification of the knowledge background of the teaching subject,and the unreasonable teaching setting.Based on the training and calibration of law major in architecture universities,the ways out for the moot court training course are:selecting cases,mainly legal dispute cases of construction engineering;strengthening teacher training to expand teachers’knowledge structure;optimizing the course design of moot court,etc.
