数据分层与侵犯网络虚拟财产犯罪研究

以数据分层现象为研究对象,根据数据在计算机信息系统的不同维度中呈现出的不同表现,作者分别阐述了数据在物理层、符号层和信息内容层中的表现及各层表现之间的关系。从数据一体多面的分层现象出发,还分析了数据和虚拟财产之间的关系,剖析了在该领域适用非法获取计算机信息系统数据罪以及传统财产类犯罪时容易出现的问题。进而从现有立法框架和未来专门立法两个维度出发,作者提出了对侵犯网络虚拟财产行为进行规制的具体路径。同时,通过从符号层和信息内容层扩大对"获取"的解释,从而填补了非法获取计算机信息系统数据罪的漏洞。为了从根本上解决问题,作者还提出了从数据层面的侵犯虚拟财产行为特点和信息层面的财产损失后果两方面对侵犯虚拟财产行为予以专门的解释亦或立法的建议。

Taking the phenomenon of data stratification as the research object,according to the different manifestations of data in different dimensions of computer information system,the author respectively expounds the manifestation of data in physical layer,symbol layer and information content layer and the relationship among the manifestations in each layer.Based on the phenomenon of data stratification,this paper analyzes the relationship between the data and virtual property,and deeply analyzes the problems in the crime of illegally obtaining computer information system data and the crime of traditional property.Based on the existing legislative framework and the future special legislation,the author puts forward the specific ways to regulate the behavior of violating the Internet virtual property.At the same time,by expanding the interpretation of"acquisition"from the symbol layer and the information content layer,it fills the loophole of the crime of illegally obtaining computer information system data.In order to solve the problem fundamentally,this paper puts forward a special explanation or legislative proposal for the behavior of violating the virtual property from two aspects:the behavior characteristics of violating the virtual property at the data level and the consequences of the property loss at the information level.
