刑事政策与刑法体系的关系--兼论刑事一体化的教义学进路与限度

理解刑事政策与刑法体系的关系需要区分体系论和解释论这两个不同面向。通过考察费尔巴哈、宾丁、李斯特乃至罗克辛对刑事政策与刑法体系关系的理解,可以发现,体系论面向体现为犯罪论体系建构需要根据价值和目标的指引,形成刑法基本概念,进而按照逻辑顺序依次展开。刑法学发展至功能主义时代,这一方法论走向更为明确。同时,由于教义学理论与社会变迁之间确实具有隐秘联系,为防止刑法沦为纯粹的规训工具,有必要认真考察刑法的价值根基与刑事政策目标。因此,在我国刑法体系的构建过程中,应当重视刑法基本概念的形成过程,这是刑事政策与刑法体系的核心交叉领域,同时规定了在教义学中贯彻刑事一体化思想的进路和限度。

Understanding the relationship between criminal policy and criminal law system requires distinguishing between two different aspects of system theory and interpretation theory.By examining Feuerbach,Binding,Liszt and even Roxin's understanding of the relationship between criminal policy and criminal law system,we can find that the system theory is embodied in the construction of the criminal theory system,which needs to be guided by values and objectives to form the basic concept of criminal law.And then expand it in a logical order.From the development of criminal law to the era of functionalism,this methodology is more clear.In the meanwhile,because there is indeed a secret connection between the doctrine theory and social change,in order to prevent the criminal law turning into a purely disciplinary tool,it is necessary to seriously examine the value base and criminal policy objectives of the criminal law.Therefore,in the process of constructing China's criminal law system,we should pay attention to the formation process of the basic concept of criminal law.This is the core cross-cutting field between criminal policy and criminal law system.At the same time,it stipulates the way and limit of implementing criminal integration thought in doctrine.
