在数字人权时代真正具有商业价值的不是单个个体的信息,而是涵盖个人信息的数据,是那些通过大数据整合后所生成的个人经济行为、消费习惯、个人爱好等内容。为此,并不是对所有个人信息数据"一刀切"式的要么允许要么禁止,而是要区分各种信息数据的属性,确定各种信息数据之间的边界,根据信息数据的属性、类别、对信息数据原始权利人的影响等进行分类,从而界定保护的级别。基于此,根据个人信息数据具有共享的基本特点,强化个人信息数据的使用更应该增加个人信息数据类型化保护的原则,对个人信息数据的保护动态化于信息数据的收集、存储、利用和处理等行为的全过程,从而在个人信息数据的保护与使用之间找到平衡点。

In the era of digital human rights,the actual commercial value is not the information of individual,but the data covering personal information,which is the personal economic behavior,consumption habits,personal hobbies and other contents generated by the integration of big data.Therefore,it is not all prohibited or allowed to collect personal information data,but to distinguish the attributes of various information data and determine the boundaries between various information data.Then,according to the attributes,categories and the impact on the obligee of information data to define the protection level.Based on this,in view of the basic characteristics of personal information data sharing,the principle of typified protection should be added to strengthen the protection of personal information data.At the same time,the protection of personal information data should run through the whole process of information data collection,storage,utilization and processing,so as to find a balance between the protection and use of personal information data.
