摘要
在疫情管控背景下,知情权与隐私权是一对矛盾的法律关系,二者之间存在冲突。在新型冠状病毒肺炎疫情暴发之时,一方面公众希望得到确诊患者及相关人员的部分信息以避免被传染;另一方面,确诊患者及相关人员又面临着个人信息被过度公开、私人隐私遭到泄露的困境。文章结合本次新冠肺炎疫情期间公众的关注点,分析公民隐私权和公众知情权的概念和保护现状,探讨在突发公共卫生事件中公民隐私权和公众知情权的利益衡量,明确二者的界限,并提出合理界定公民隐私权和公众知情权的界限的建议。
In the context of epidemic control,the right to know and the right to privacy are contradictory legal relations,and there are conflicts between them.During the outbreak of Covid-19,on the one hand,the public wants to get some information about confirmed patients and relevant personnel to avoid being infected;on the other hand,confirmed patients and relevant personnel are faced with the dilemma of excessive disclosure of personal information and leakage of private privacy.Combining with the public concerns during Covid-19 outbreak,this paper analyzes the concept of citizen right of privacy and the public's right to know and to protect the status quo,explores the citizen right of privacy in public health emergencies and the interests of the public's right to know,makes clear boundaries,and puts forward the reasonable definition of citizen right of privacy and the limits of the public's right to know.
