职务犯罪“调诉衔接”问题研究

A Study on the Combination of Supervision Procedures and Criminal Procedures for Duty Crimes

国家监察体制改革的核心内容是将检察机关的反贪污、反渎职等职能转隶至监察委员会,相应地产生了针对职务犯罪的监察调查程序。作为一项全新的犯罪调查程序,监察调查程序与刑事诉讼程序的衔接,即“调诉衔接”需要认真考量。实现监察调查程序与刑事诉讼程序的顺畅衔接,既是实体规则得以实现的前提,也是制约权力,防止权力滥用、误用的需要。《监察法》与《刑事诉讼法》关于职务犯罪的“调诉衔接”主要体现在三个方面:一是明确了监察机关与检察机关的关系;二是重新配置了人民检察院的侦查权;三是删除了《刑事诉讼法》相关条款与《监察法》不匹配之处。具体来说,“调诉衔接”主要包含四个方面的内容:第一,立案与移送的衔接;第二,案件管辖的衔接;第三,留置与刑事强制措施的衔接;第四,证据适用的衔接。

The core of the state supervision system reform is to transfer the functions of the procuratorial organs to the supervisory commissions in fighting against corruption and malfeasance,accordingly bring into being the supervision procedures for duty crimes.We should take the combination of supervision procedures and criminal procedures into serious consideration as the former are completely new for investigation.The effective combination of the two is not only the precondition of realizing substantive rules but also the necessity of restricting power and preventing power abuse or misuse.The combination of supervision procedures and criminal procedures for duty crimes finds its expression in The Supervision Law and The Criminal Procedure Law in three aspects:1.The relationship between supervisory organs and the procuratorial organs is clarified.2.The power of investigation of the people’s procuratorates is reallocated.3.Rules in the Criminal Procedure Law that were different from those of the Supervision Law are deleted.Specifically,the combination mainly includes four issues:1.the combination of acceptance and transfer of cases;2.the combination of jurisdiction of cases;3.the combination of detention and coercive measures;4.the combination of evidence applications.
