我国农村环境侵权诉讼启动模式探析

Initiation Mode of Rural Environmental Tort Litigation in China

农村环境侵权行为种类增多,损害后果严重,需要通过诉讼方式对环境权和民事主体的私权进行救济。但诉讼模式类型众多,应当界定农民、农村承包经营户、农村集体经济组织、村民委员会、村民小组启动各种诉讼模式的主体资格,并明确其提出诉讼请求的范围。

The types of rural environmental torts are increasing and the consequences of damage are serious.It is necessary to relieve environmental rights and private interests of civil project through litigation.However,there are many types of litigation modes.We should define the main qualification of farmers,leaseholding rural household,rural collective economic organizations,villager committees and villagers'groups to initiate various litigation modes,and clarify the scope of their litigation requests.
