摘要
东京奥运会延期举行,是奥运会历史上的重大事件,受到国际体育界和相关各界的关注。京鲁两地体育法学组织联合伦理学界,就东京奥运会延期相关法律与伦理问题展开研讨。此次座谈会围绕东京奥运会延期是否存在法律上的合法性和伦理上的正当性、奥运延期对各利益相关方所产生的影响以及可能的救济途径、新冠肺炎疫情作为不可抗力的构成和举证问题、东京奥运会延期对北京冬奥会可能的影响、奥运会延期对奥林匹克城市主办协议完善的意义、奥运会延期决策的程序正义和各利益相关的参与治理等问题展开。研究认为,大规模的全球疫情导致奥运会延期是出于对人类健康的终极关怀,符合奥林匹克精神和价值追求,具有伦理上的正当性,但延期也会对各利益相关方产生重大影响,未来需要在赛事安排、损害救济、协议修改、章程重新审视等方面作出妥当安排,以实现奥林匹克运动在重大灾害背景下的有效治理。
The postponement of the Tokyo Olympics has attracted the attention of the international sports community and related circles.Sponsored by the Beijing and Shandong Law Societies for sports law and talents from the ethics community,this internet meeting was held to discuss the legal and ethical issues related to the postponement of the Tokyo Olympics.The symposium focused on whether the postponement is legal or not,the impact of the Olympic postponement on various stakeholders and possible remedies,the composition and proof of the COVID-19 epidemic as force majeure,the possible impact of the postponement on the Beijing Winter Olympic Games,the significance of the postponement to the perfection of the host agreement of the Olympic host cities,the procedural justice of the decision-making of the postponement and the participation of various stakeholders in the governance.Participants generally believed that the postponement of the Olympic Games due to this large-scale global epidemic correspond to the ultimate concern for human health,in line with the Olympic spirit and value pursuit,therefore it was ethically justified,but the postponement would also give much effect on various stakeholders.So it is necessary to make proper arrangements in the future regarding the arrangement of events,damage relief,amendments to agreements,and re-examination of the Charter of IOC,in order to achieve good governance of the Olympic movement in the context of major disasters.
