摘要
截止2014年底,我国民航共有1部法律、29部行政法规、121部规章以及389项行业标准,对保障民航安全起到了至关重要的作用,但依然存在安全监管法律依据和规章标准尚不完善等问题。本文通过阐述中、美两国航空法规体系,对比安全相关法规要点,得出中美航空安全管理制度在安全信息、事故调查以及综合安全管理等方面的差异。美国是世界上航空运输的发源地,分析其健全的航空法规对于完善我国航空安全法规体系具有重要意义。
By the end of 2014,China’s civil aviation has a total of 1 law,29 administrative regulations,121 rules and 389 industry standards,which have played a vital role in ensuring the safety of civil aviation,but there are still problems such as imperfect legal basis and rules and standards for safety supervision.This paper expounds the aviation regulations of China and the United States,compares the key points of the relevant safety regulations,and concludes the differences between the aviation safety management systems of China and the United States in the aspects of safety information,accident investigation and comprehensive safety management.The United States is the birthplace of air transport in the world.The analysis of its relatively sound aviation regulations is of great significance to the improvement of China’s aviation safety regulations.
