案例推理技术在治安行政执法规范化中的应用研究

治安行政执法规范化是提升公安工作法治化水平,全面落实严格规范公正文明执法的要求,同时也是更好地促进社会公平正义、维护人民合法权益的基本要求。但是,由于执法对象的复杂性以及法律的抽象性等原因,治安行政执法工作中依然存在着滥用自由裁量权等执法不规范问题,这严重损害了公安机关的公信力和人民群众的满意度,影响了社会的和谐稳定,亟须采取相关措施提高治安行政执法水平。为了进一步规范治安行政执法行为,将案例推理技术应用于治安行政执法规范化研究,案例推理技术根据当前待解决问题的特征属性,通过相似案例检索可以为治安民警处理治安问题提供参考解决方案,辅助民警迅速作出正确决策,做到执法行为可控、执法结果合理。同时,治安民警参考先前的处理结果,能够防止其在类似的执法环境下滥用自由裁量权,使处理结果更加公平正义,引导治安行政执法朝着更加规范化的方向发展。

The standardization of public security administrative law enforcement is to raise the level of legalization of public security work,fully implement the requirements of strict and standardized law enforcement in a fair and civi-lized manner,and also better meet the basic requirement of promoting social fairmess and justice and safeguarding the legitimate rights and interests of the people.However,due to the complexity of law enforcement objects and the ab-stractness of the law,there are still imegulaities in law enforcement such as abuse of discetion,which serioualy um-dercut the credibility of public security agencies and the satisfaction of the people,affecting the harmony and stability of society.It is urgent to take relevant measures to improve the level of public security administrative law enforce-ment.In order to further regulate public security administrative law enforcement behaviors,the author applies case-based reasoning technology to the standardization research of public security administrative law-enforcement.Case-based resoning technology can provide reference solutions for order police to deal with public security problems through similar case retrieval based on the key features of the current problems to be solved.Quickly make correct decisions to control law enforcement behaviors and make law enforcement results reasonable.At the same time,the public order police can refer to previous processing resuts to prevent them from abusing discretion in a similar law enforcement environment,making the processing results more fair and just,and guiding law enforcement administra-tive law enforcement towards a more standardized direction.
