摘要
在宗教治理法治化的道路上,人口流动性带来的考验不容忽视。文章依据课题组在东南沿海城市社区的抽样调查数据,分析了影响少数民族流动人口宗教治理法治化水平的主要因素及其作用机制。研究发现,少数民族流动人口的宗教信仰方式对“法治化意识”与“法治化行为”均有正向影响;影响少数民族流动人口法治化水平的主要因素是宗教信仰的社会性而非私人性。研究表明,提升少数民族流动人口的宗教治理法治化水平,需要完善相应的责权配置体系和运行体系的法治化,确保少数民族流动人口的宗教信仰方式呈现应有的社会性;构建社会化的组织网络,从治理理念、治理路径和监督体系等方面建设共建共治共享的治理共同体;充分发挥国家在场的制度-心理效应,加强社会支持体系的法治化建设,夯实宗教治理法治化的社会心理基石。
In modern society with increasing population mobility,the challenges brought by the religious groups’mobility to the legalization of religious governance can not be ignored.Based on the sample survey data in the Yangtze River Delta,this paper analyzes the relationship between ethnic minorities floating population’modes of religious belief and the legalization of religious governance,as well as the main dynamic mechanism.The study finds that the religious belief of ethnic minorities floating population has a significant positive effect on the legalization level;it is the social attributes of religious belief,rather than private,that improves the legalization of religious governance about ethnic minorities floating population.In order to raise the legalization level of the religious governance about ethnic minorities floating population,we should improve the legalization of the rights and responsibilities configuration system and the operation system,and promote the religious legislation;advance the legalization of religious governance capability from the aspects of governance concepts,governance route and supervision system;promote the establishment of the legal system of religious organization,control and guide the private mode of belief;strengthen the legalization construction on the support system of religious governance and solid the psychological foundation for religious governance.
