摘要
“程序明显不当”作为对程序要素的审查标准,由“程序”(核心要素)与“明显不当”(规范依据)有机结合,是人民法院对法律现象及规律的总结与续造。指导案例88号通过“个案”与“规则”互动,提炼出“程序明显不当”的内涵,发展出“价值判断-定性描述-规范转化”的规范说理,为适用“程序明显不当”作出示范,体现了审查标准在司法变迁中的本土化、实证化与规范化。
"The obviously improper procedure"should be as a review standard for program elements which is organically combined by"procedures"(core elements)and"obviously inappropriate"(normative basis).It is the refinement and continuation of legal phenomena and laws by people's courts.Guiding Case No.88 interacted with the"value judgement""Qualitative description"and"Normative presumption",which provided a model for the application of the"proceeding obviously inappropriate"evaluation process elements,reflecting the review criteria localization,demonstration,and standardization in the judicial transition.
