关于我国精准扶贫法治保障体系构建的思考

Building of the Legal Guarantee System on PovertyAlleviation in China

党的十九届四中全会明确指出:“坚持全面依法治国,建设社会主义法治国家,切实保障社会公平正义和人民权利的显著优势”,强调要“坚决打赢脱贫攻坚战,巩固脱贫攻坚成果,建立解决相对贫困的长效机制”。构建精准扶贫法治保障体系,强化精准扶贫法治建设不仅成为中国减贫扶贫的重要内容,而且也是巩固脱贫成果、防止返贫、建立解决相对贫困长效机制的制度保障。针对当前精准扶贫制度上的“政策当道,法律缺位”问题,亟需出台国家农村扶贫开发法,完善现有扶贫相关法律制度,构建精准扶贫“宪法—国家农村扶贫开发立法—精准扶贫法律法规”制度体系。

The Fourth Session of the 19th CPC Central Committee clearly stated,‘Insist on the comprehensive advantage of administering the country in accordance with the law,build a socialist country ruled by law,and effectively protect the fairness and justice of the society’and emphasized‘the need to resolutely win the fight against poverty,consolidate the results of the fight against poverty,and establish a long-term mechanism to resolve relative poverty’.The precise legalization of poverty alleviation has not only become an important content of China's poverty reduction and poverty alleviation,but also the institutional guarantee for consolidating the results of poverty alleviation,preventing return to poverty,and establishing a long-term mechanism to resolve relative poverty.Facing the problem o‘f policy is right,law is absent’on the current precision poverty alleviation system,There is an urgent need to promulgate the National Rural Poverty Alleviation and Development Law,improve the existing legal system related to poverty alleviation,and build a system for precise poverty alleviation‘Constitution—National Rural Poverty Alleviation and Development Legislation—Precise Poverty Alleviation Laws and Regulations’.
