Study on Digital Resource Donation of Public Libraries

《中华人民共和国公共图书馆法》的颁布为进一步研究公共图书馆领域的捐赠机制提供了法律基础。大数据时代数字资源逐渐成为信息表达的主要形式,传统的捐赠法律关系也随之发生变化。本文以公共图书馆事业的公益性为中心,分析研究了数字资源捐赠过程中的捐赠协议及其他具体捐赠制度,探讨了公共图书馆数字资源捐赠的对策措施,以推动公共图书馆捐赠事业的健康发展,促进公民文化权利和发展权利的实现。

The enactment of the People’s Republic of China Public Library Law provides a legal basis for further research on the mechanism for digital resource donation in the field of public libraries.In the age of big data,digital resources gradually become a major form of information expression,the traditional legal relationship of donation also changes.Centering on the characteristic for public benefits of public libraries,this paper analyses and studies the donation agreements and other specific donation systems in the process of digital resource donation,probes into the countermeasures of donation,in order to promote the healthy development of public library donation and facilitate the fulfillment of rights of citizens to culture and development.
