摘要
医疗技术的发展,患者权利意识的增强,都使得知情同意的实施陷入困境并逐渐异化。对知情同意权进行再反思后发现,患者的知情同意的本质和功能应该是和谐医患关系的润滑剂。从这一本质出发,对知情同意制度的理论与实践进行重构:加强医生权利保障,提升其人文素养,限缩知情同意的边界,构建屈从性医患法律关系;运用行业、媒体等力量营造知情同意实施的和谐环境;探索合理的法律责任形式,作为保障患者知情权的后盾。
The implementation of informed consent has been in trouble and gradually alienated,with the development of medical technology and the enhancement of patients’rights awareness.Founded that the essence and function of right awareness of patient should be lubricant for harmonious doctor-patient relationship after rethinking the right of informed consent.Reconstructed the theory and practice of informed consent system from the nature:strengthening the protection of right for doctor,enhancing humanistic quality,limiting the boundary of informed consent,constructing submissive legal relationship for doctors and patients;creating a harmonious environment for the implementation of informed consent through using industry,media and other forces,explore a reasonable form of legal liability to protect the patients’rights.
