Entity Correction Based on Authority

瑕疵授权的存在和我国专利转化率低的客观现实,要求必须完善授权后更正程序。本文建议在现有专利制度中,增加国务院专利行政部门依职权进行实体更正的程序,即对于授权后发现的明显实体缺陷,国家知识产权局可依职权进行更正。更正程序可通过两种途径实施:一是明确国家知识产权局可依职权启动无效宣告程序;二是建立授权后国家知识产权局依职权撤销程序。通过上述途径,希望可更好发挥行政机关纠错的主观能动性,保护社会公共利益,满足各方对于更正的不同需求。

Defective authorization and low rate of patent commercialization in China calls for improved correction procedure after authorization.This paper proposes to add entity correction procedure based on authority in the current patent system to enable China National Intellectual Property Administration(CNIPA)to correct obvious entity defects found after authorization based on authority.Specifically,there are two approaches:the first approach is to make clear regulations stipulating that CNIPA can start the invalidation procedure based on authority;the second is to establish the revocation procedure after authorization based on authority.Through these approaches,it is hoped that the administrative agency take the initiative to correct errors,protect public interests and meet different needs of correction for various parties.
