我国监察官制度设计初探--以监察官法的制定为视角

Research into the Design of China’s Ombudsman System:A Perspective from the Formulation of Ombudsman Law

监察官制度是中国特色监察体系的基础性制度。要通过制定监察官法,明确监察官制度的基本框架和主要内容,真正建立起符合我国基本国情、监察权属性和监察机关特点的监察官制度。要稳妥审慎地推进我国监察官法的立法工作,合理界定监察官的范围,科学设定监察官的条件,确立监察官的单独等级序列,建立监察官的选拔与交流机制、考核与奖惩机制,明确监察官的权利义务和职业保障,强化对监察官的监督与管理。

The Ombudsman system is a fundamental part of China's supervision system.Such a system should be established catering to the fundamental situational China,properties of supervision power and features of the supervising organizations by formulating the ombudsman law to make clear the basic framework and major contents of the ombudsman system.Legislation regarding the area should be promoted with prudence,the scope of ombudsman to be reasonably established,conditions for their position to be scientifically defined,an independent rank sequence for them to be set up,the mechanism for their recruitment and exchange,assessment and award and punishment to be constructed,their rights,responsibility and professional security to be defined,supervision and management on them to be strengthened.
