确认判决可执行争议的“帕累托改进”对策

"Pareto Improvement"Proposal to Enforceable Dispute of Declaratory Judgement

人民法院在执行过程中对确认判决是否具有给付内容的认定产生分歧,由此产生了确认判决可执行、不可执行、部分可执行的争议。面对争议,在坚持确认判决不可执行的前提下,对确认之诉的功能、诉的类型之间的关系等相关法理以及司法实践的惯常做法和诉讼经济等因素进行了分析。最终提出限制确认之诉确认对象的范围和行使法官释明权两个对策,以期从源头预防性地解决实践中确认判决可执行争议。

In the course of execution,the people's court has disagreements on whether the declaratory judgment has the content of payment,which gives rise to the dispute that the confirmation judgment is enforceable,unenforceable and partly enforceable.In the face of controversy,on the premise of insisting that the declaratory judgment is not enforceable,this paper analyzes the function of confirming the lawsuit,the relationship between the types of litigation and other relevant legal principles,as well as the common practices of judicial practice and litigation economy.Finally,this paper puts forward two proposals:restricting the scope of the confirmation object and exercising the judge's right of interpretation,in order to solve the enforceable dispute of the declaratory judgement from the source.
