摘要
城市发展边界问题早已提出,但对其的解决,一直不理想,主要原因在于地方政府对"土地财政"的依赖以及由此产生的"卖地扩城"行为。此次《土地管理法》修订,对"公共利益"进行了界定,提升了征地成本,完善了征地程序,加强了对"永久基本农田"的保护;允许集体经营性建设用地入市,打破了地方政府对土地一级市场的垄断,同时以提取土地增值收益调节金的形式寻求了对"土地财政"的替代。上述规范的适用,将对城市边界的形成和限制城市无序扩张起到积极作用。
The boundary problem of urban development has been raised for a long time,but the solution to this problem has not been satisfactory.The main reason lies in the local government’s reliance on"land finance"and the behavior of"land sales and city expansion".The revision of the"Land Management Law"defines"public interest",raises the cost of land acquisition,improves the procedures for land acquisition and strengthens the protection of"permanent basic farmland".It allows collective operating construction land to enter the market and breaks the monopoly of the local government on the primary land market,seeks a replacement for"land finance"in the form of extraction of land value-added income adjustment funds.The application of the above norms will play apositive role in the formation of urban boundaries and the restriction of urban sprawl.
