涉农药司法鉴定意见采信机制研究

涉及农药的司法鉴定工作是司法鉴定工作的重要组成之一。囿于大环境下涉农药司法管理复杂性及难度较高等因素,我国现阶段尚不具有统一化、系统化的涉农药司法鉴定采信标准体系,而衡量鉴定意见的涉农药司法鉴定标准体系及规范更是少之又少。基于标准化理论,以实践为核心导向,结合涉农药司法鉴定活动的特征及显示需求,借助相关案例,首先阐述涉农药司法鉴定与鉴定意见采信机制内涵,而后解析我国涉农药鉴定意见采信机制现状,最后为构建完备的涉农药司法鉴定意见采信机制提出若干建议,希望为涉农药司法鉴定标准化建设及涉农药司法鉴定实践提供一定参考。

Judicial identification of pesticides is one of the important components of judicial identification.Due to factors such as the complexity and difficulty of the judicial management of pesticides in the large environment,at present China does not yet have a unified and systematic acceptance standard system for pesticide judicial identification,and the standard system for pesticide judicial identification and the standards for measuring opinions are rare.This research is based on standardization theory,takes practicality as the core guide,combines the characteristics and displays requirements of forensic pesticide-related judicial identification activities.With the help of relevant cases,this study first explains the connotation of the pesticide-related judicial identification and expert opinion acceptance mechanism,and then analyzes the status quo of the acceptance mechanism of pesticide identification opinions in China,and finally puts forward some suggestions for the establishment of a comprehensive mechanism for the acceptance of pesticide-related judicial identification opinions,hoping to provide a certain reference for the establishment of pesticide-related judicial identification standardization and the practice of pesticide-related judicial identification.
