美国女性解放的路径看似杂乱无章,实则蕴含一种辩证的螺旋式发展关系:女权主义实践激发女权主义法律理论,女权主义法律理论形塑女权主义法律实践,女权主义法律实践重构女权主义法律理论。总之,女权主义实践和女权主义法律理论之间的互动,使美国女权主义者未受制于既有的修宪和立法程序,而是通过司法的方式助推女性解放。虽然不同国家女性解放的模式和途径存在差异,美国女性解放的经验亦非普世皆准,但是,通过取其精华去其糟粕,美国女性解放的经验或许能为中国突破现实瓶颈,推动女性解放事业的发展带来启发。

The path of women’s liberation in United States seems to be disorganized,but there is a dialectical spiral relationship behind it:feminist practice stimulates feminist legal theory,feminist legal theory shapes feminist legal practice and feminist legal practice reconstructs feminist legal theory.In general,the interaction between feminist legal practice and feminist legal theory promotes American women’s liberation through judicial approach,instead of limiting feminist movement by the existing constitutional revision and legislation procedures.It’s true that there are differences in the models and approaches of woman’s liberation in different countries and regions,and the experience of United States is not universal.However,the American experience of women’s liberation may bring inspiration to breakthrough of the reality bottleneck and promote the development of Chinese women’s liberation cause by taking lessons in American practice.
