金融司法的发展--基于制度变迁的历史逻辑

Development of Financial Justice:Historical Logic Based on Institutional Change

伴随着改革开放与市场经济建设的宏伟历程,我国金融司法发展历经经济审判时代、大民事审判时代与2008年金融危机后三个发展阶段,在专业化组织建设、指导理念、案件审理、司法经验积累与裁判规则形成等方面渐次演进,当前已呈现出司法积极参与国家治理的显著特征。在不断改革与调整中,中国金融司法形成了自己独特的制度经验:坚持金融司法的政治属性、法治属性、社会属性与智慧属性。中国金融司法的演进既受到顶层制度设计的强力推动,又不断从基层司法经验中获取养分,体现了制度变迁的强制性与诱致性以及"自上而下"与"自下而上"相结合的发展特征。

With the grand course of reform and opening-up and the market economy construction,the development of China's financial judicial system has gone through three stages of development,the era of economic trial,era of great civil trial and the post-financial crisis era.And it gradually evolved in such areas as professional organization construction,guiding idea,case trial,accumulation of judicial wisdom and formation of rules of adjudication,and has shown the remarkable characteristics of judicial active participation of national governance.The unique institutional experience of China's financial justice lies in:adherence to political attributes,people's attributes,rule of law attributes,social attributes and intellectual attributes.The evolution of China's financial justice embodies the mandatory and induced nature of institutional change,as well as the"top-down"be harmoniously with"bottom-up"development characteristics.
