On the Legal Regulation of Financial Innovations in Hainan Free Trade Port

金融创新是中国特色自由贸易港建设的关键与核心,海南自由贸易港金融创新应重点围绕融资汇兑、资本项目兑换、外汇结算清算、离岸金融创新展开。海南自由贸易港金融创新需要争取中央立法授权、政策供给与制度创新,在金融市场准入、外汇管理体制改革、跨境资金融通、离岸金融创新等业务模式上探索"中国特色"与"海南范式"。吸收与借鉴国际自由贸易港在金融创新与风险防范上的成功经验,更加注重强化金融监管的顶层设计,将维护金融稳定与秩序作为第一要务,着力金融消费者利益保护,运用监管科技防范化解系统性金融风险。

Financial innovations are the core of the construction of free trade port with Chinese characteristics.The financial innovations of Hainan Free Trade Port are supposed to focus on the convenience of exchange and remittance for investment and financing,the capital account convertibility,the foreign exchange settlement and clearing,as well as the offshore financial innovation.Striving for the legislative power authorized by the central government,the supply-side policy and the system innovation,the financial innovations in Hainan Free Trade Port should explore the"Chinese characteristics"and"Hainan paradigm"in such business modes as the financial market access,the reform of foreign exchange management system,the cross-border financing integration,and the offshore financial innovation.While absorbing and learning the successful experience of financial innovation and risk prevention from the international free trade ports,Hainan should further strengthen the top-level design of financial supervision,give the first priority to maintaining the financial stability and order,protect the interests of financial consumers,and prevent and resolve the systemic financial risks by means of the regulatory technology.
