走私刑事移送行政处罚案件执行难问题及应对

The Difficulties and the Countermeasures in Execution of Smuggling Cases of Criminal Transferred to Administrative Punishment

近年来,走私刑事移送行政处罚案件数量呈增长趋势。本文结合案例指出走私刑事移送行政处罚案件存在执行难问题:延期或分期履行行政处罚存在一定执法缺陷,当事人以各种方式逃避处罚、对境外当事人的执行面临困难等。进行原因分析后提出相关应对措施:立法上探索建立行政执行和解制度,执法上加强对当事人财产追踪控制,刑事认罪认罚制度推及至行政处罚,探索行政财产保全措施,海关积极融入社会信用体系建设等。

In recent years,smuggling cases of criminal transferred to administrative punishment have been increasing.Combined with the cases,this article illustrates the difficulties in execution of smuggling cases of criminal transferred to administrative punishment.There are some defects in law enforcement in delay or installment of administrative penalty fulfillment,some litigants avoid punishment in various ways,and we are facing difficulties in the execution of foreign litigants.After analyzing,we propose countermeasures accordingly.In legislation,exploring the establishment of an administrative reconciliation system.In law enforcement,strengthening the control of the litigants’property.The system of criminal confession and punishment should be extended to administrative one.For Customs,property preservation should be explored in administrative enforcement,and actively integrated into the construction of the social credit system.
