On Legal Protection of Biological Genetic Resource Security

生物遗传资源安全作为生物安全的重要组成部分,在保障资源安全、生态安全乃至国家安全方面发挥着不可替代的作用。在价值选择层面,生物遗传资源法制应着重协调价值体系中的内在冲突。在此基础上,应当对生物遗传资源权属作出科学安排,建立公平公正的生物遗传资源获取与惠益分享机制,同时健全生物入侵防范机制,以确保生物遗传资源安全的充分实现。

As one of the most significant aspects of biosecurity,biological genetic resource security plays an irreplaceable role in ensuring the resource security,ecological security,and even national security.The inherent value conflict in the legal system of biological genetic resource should be focused.Based on this theoretical approach,a proper arrangement of resources ownership is the presumption of effectiveness of other regulatory tools.The scientific and reasonable legal mechanism for access and benefitsharing(ABS)of biological genetic resource and related traditional knowledge(TK)should be established.In addition,the regulatory measures for combating biological invasion should also be improved to ensure the biological genetic resource security.
