环境行政复议改革的理论逻辑与现实展开——以义乌模式为视角

The Theoretical Logic and Real Implementation of Environmental Administrative Reconsideration Reform:From the Perspective of the Yiwu Model

环境行政复议是行政复议在生态环境领域的具体化,具有区别于一般行政复议的特殊性。义乌市作为全国首家专门行政复议局改革试点,其在解决纠纷的过程中发挥了总阀门的作用。发挥环境行政复议的作用可以实现我国行政系统内部法治资源和自我纠错监管机制的科学利用,促进环境行政复议制度的生态化,进一步预防和化解社会环境治理矛盾,实现社会的现代化治理。目前,实践中存在申请人范围过窄、复议程序不完善、与环境行政公益诉讼衔接机制不畅、缺乏体系化监管等问题。本文以义乌模式为视角,研究环境行政复议过程中如何运用义乌模式完善环境行政复议的程序机制,更好地解决我国现阶段存在的环境行政纠纷处理问题。

Environmental administrative reconsideration is the concretization of administrative reconsideration in the field of ecological environment,and has the special characteristics that are different from general administrative reconsideration.Yiwu City,as the country's first pilot for the special reform of administrative reconsideration bureau,has played the role of general valve in the process of resolving disputes.Exerting the role of environmental administrative reconsideration can realize the scientific utilization of the rule of law resources and self-correction supervision mechanism within the administrative system of our country,promote the ecologization of the environmental administrative reconsideration system,further prevent and resolve social environmental governance contradictions,and realize modernized social governance.At present,there are problems such as too narrow scope of applicants,imperfect reconsideration procedures,poor connection mechanism with environmental administrative public interest litigation,and lack of systematic supervision.Taking the Yiwu model as a perspective,this paper studies how to use the Yiwu model to improve the procedural mechanism of environmental administrative reconsideration in the process of environmental administrative reconsideration,in order to better solve the problems of environmental administrative disputes in China at present.
