摘要
如何在法学教学中重视培养学生的法律思维,而不仅是传授法律知识,这是值得所有法律教育工作者深入思考的问题。文章以《合同法》和《侵权责任法》为例,通过解读行为能力的概念,构建合同法和侵权责任法的知识体系,探究赠与合同撤销权和用工者替代责任的规范本质,论述了法律思维培养在教学内容上应侧重于概念、体系和规范本质;同时,通过分析有关过错责任的三个案例,论述了法律思维培养在教学模式上应采用"从情境到规则"的案例式教学。
How to cultivate students’ legal thinking in legal education rather than only impart legal knowledge is a problem, which is worthy of all legal educators’ deep thinking. This paper, taking the Contract Law and the Tort Law as example, interprets the concept of civil active ability;the knowledge system of Contract Law and Tort Law;discusses two legal normative natures: revocation right of the gift contract and replacement responsibility of the employee, thereby expounds the cultivation of legal thinking should focus on the teaching content of concept, system and normative natures;at the same time, this paper analyze three cases of fault liability, thereby suggests the cultivation of legal thinking should adopt the case teaching mode of "from situation to rule".
