司法审判中统一法律适用路径探析

On the Path of Uniform Law Application in Judicial Trial

法律适用是法律实施的主要途径。目前在我国的司法审判中,由于法律适用分歧较大,导致准确适用法律较为困难。尽管《最高人民法院关于建立法律适用分歧解决机制的实施办法》规定了解决法律适用分歧的决策机构及程序,但这些框架性的规定并未有效解决司法审判中的法律适用分歧。本文对产生法律适用分歧的原因进行解析后认为,应进一步增强法律规定的明确性,提升法官准确适用法律的能力,完善案例指导制度,以期从源头上消除司法审判中的法律适用分歧,树立与维护司法裁判的公信力。

The application of law is the main way of law enforcement.At present,in the judicial trial of our country,due to the great differences in the application of law,it is difficult to apply the law accurately.Although the measures for the implementation of the Supreme People’s Court on the establishment of a mechanism for resolving differences in the application of law,which came into effect on October 28,2019,provides for decision-making bodies and procedures for resolving differences in the application of law,these framework provisions do not effectively resolve differences in the application of law in judicial trials.After analyzing the causes of the differences in the application of law,this paper believes that we should further enhance the clarity of the legal provisions,enhance the ability of judges to apply the law accurately,improve the case guidance system,in order to eliminate the differences in the application of law in the judicial trial from the source,and establish and maintain the credibility of the judicial judgment.
