摘要
海盗仍是当今世界的顽疾,国际法的发展历程使得海盗罪的概念出现分歧,并由此影响了对海盗的打击。考察现代海盗活动的统计数据和地理区域,并根据各种不同的标准对海盗罪进行分类,有助于精准打击海盗。打击海盗的国际法律机制在实践中仍存在困境,中国刑法与《俄罗斯联邦刑法典》中相关条文也存在现实问题,海盗的有效治理最终要依靠国际合作,为此,应进一步优化国际合作的法律机制。
Pirates are still the vulnerability in this world.The development of the international laws created the difference between the concepts of the piracy crime and accordingly affects the fighting against the crime.Investigating the statistics and geographical areas of modern piracy activities and classifying the crimes according to different standards will help to fight pirate accurately.The international legal mechanism to combat pirate still has difficult circumstances,and there are also practical problems in relevant provisions of Chinese Criminal Law and Russian Criminal Code.The governance of piracy crimes ultimately depends on international cooperation,therefore,the legal mechanism of international cooperation should be further optimized.
