法律风险视域中的大学生创业保障机制构建

Construction of College Students'Entrepreneurship Guarantee Mechanism from the Perspective of Legal Risks

据调查显示,防控法律风险不力已成为导致大学生创业失败的主要原因之一。大学生在创业过程中缺乏抵御法律风险的意识,在创业组织内部又未建立完善的法律风险控制体系。目前针对大学生创业的有效防范法律风险的外部保障明显不足,主要表现在高校创业法律风险教育的薄弱,以及政府对创业组织抵御法律风险的扶助乏力上。为此,需要构建以强化创业组织积极防御法律风险为核心的外部保障机制,包括从高校层面推进大学生创业法律风险防控课程建设,以及从政府层面为创业组织建立企业法律风险控制体系提供有力支持。

According to the survey,the inadequate prevention and control of legal risks has become the one of main reason for the failure of college students'entrepreneurship,which is mainly manifested in the lack of ability of college students to resist the legal risks of entrepreneurship and the lack of internal legal risk control system of entrepreneurship organizations.Now,there is no guarantee mechanism to help college students'entrepreneurship effectively guard against legal risks,which highlights the weakness of legal risk education in college entrepreneurship,and the inadequate government support for entrepreneurship organizations to resist legal risks.In this regard,it is necessary to build a guarantee mechanism with the core of strengthening entrepreneurial organizations'active defense against legal risks,including promoting the construction of legal risk prevention and control courses for college students'entrepreneurship from the university level,and providing strong support for the establishment of legal risk control system for entrepreneurial organizations from the government level.
