论网络交易第三方平台的行政监管义务

On the Administrative Supervision Obligations of Third-party Platforms for Online Transactions

近年来,基于网络治理的难度,我国立法强制课予网络交易第三方平台一定程度的行政监管义务,并且这种监管义务还一度呈强化趋势。然而,在现实场景中,源于网络商务环境的复杂性、相关立法的滞后性以及作为私人主体追求利润最大化的考量等,第三方平台未能有效配合政府监管部门进行监管,同时后续的追责问题也存在空白之处。今后应通过精良的制度设计激励网络交易第三方平台参与到合作监管当中,并且进一步落实对第三方平台履行行政监管义务的监督,完善行政监管的后续责任。

In recent years,in light of the difficulties with network governance,China's legislation has imposed a certain degree of administrative supervision obligations on third-party platforms for online transactions,and this supervision obligation has been intensifying for a time.However,in the real world,due to the complexity of the online business environment,the lagging of relevant legislation,and the consideration of the pursuit of profit maximization as a private subject,third-party platforms have not been able to effectively cooperate with government regulators for supervision and follow-up responsibility.There are also gaps in accountability.In the future,the sophisticated system design should be used to encourage third-party platforms for online transactions to participate in the public-private cooperation,and further implement the supervision of the third-party platform in performing its administrative supervision obligations and improve the follow-up responsibility for administrative supervision.
