疫情期间涨价型哄抬价格行为的柔性规制研究——以告诫制度的形式化问题为视角

A study on Flexible Regulation of Price Bid-up in Epidemic Period:From Perspective of Formalization of Warning System

新冠肺炎疫情期间,涨价型哄抬价格行为的刚性处罚严重限制了执法规范的效果,由此需要告诫制度进行柔性中和。但纵观我国的立法及实践,执法依据层级低、告诫功能定位不准以及具体程序缺失等问题导致告诫制度实施的形式化,执法刚性的缺陷未能消解。因此,告诫制度应理顺规范体系的应然框架,修正其功能定位并强化功能效果,在此基础上,再进一步规范和细化告诫制度的具体程序规范,使告诫制度的实施走向规范化和法治化道路。

During the epidemic period of COVID-19,the rigidity of administrative penalty severely limits the regulating of price raising behavior.Therefore,the implementation of flexible warning is needed to neutralize the rigid law enforcement.However,throughout the legislation and practice of China,the problems such as the low level of law enforcement basis,the improper function orientation of warning system and the lack of specific procedures for the implementation of norms.So the implementation of the warning system is for still functioning on the surface,and the defect of the rigidity of law enforcement has not been resolved.Hence,it is necessary to straighten out the framework of the legal basis system,revise the function orientation of the warning system and strengthen its effectiveness.Then it is essential to further standardize and refine the specific procedure specification of the warning system,and make the implementation of the warning system move towards the road of standardization and rule of law.
