摘要
监察机关认罪认罚从宽处理建议制度推行有利于国家反腐目标的实现,亦与公正与效率兼顾、宽容与严明相济的司法理念相耦合。但现行《监察法》的颁布在为其创造条件的同时,也导致了其与检察机关从宽量刑建议制度之间的法律地位角逐,进而使其“软拘束效力”错位、适用规则不详。未来监察机关从宽处理建议制度的发展,应当正视认罪认罚自愿性、监察机关公正性以及移送至检察机关所存在的非法证据排除启动难、适用衔接“断层”等问题,需要加强监察机关自我监督、引入律师外部监督,保障从宽处理建议的合法性,还需要推动立法实现“法法衔接”,甄别对待监察机关从宽处理建议的法律效力,对建议内容不合法、程序不合规的应当否定,在“法法”还未衔接的背景下,应从细化监察机关从宽处理建议的从宽标准和移送程序另辟蹊径,保障其可操作性。
The suggestion system of guilty plea leniency by supervisory organs is conducive to the realization of national anti-corruption effect,and is coupled with the judicial idea of balancing justice and efficiency,tolerance and strictness.The promulgation of the supervision law makes it possible,but also leads to conflict of the similar system between the supervisory organ and the procuratorial organ,which makes the effect of soft binding force misplaced and the applicable rules unknown.The following problems should be faced up to,including the voluntary of guilty plea,justice of supervisory organ,difficulty in launch an illegal evidence exclusion in transfer to the procuratorial organ,and lack of application convergence.It is essential for supervisory organs to strengthen self-supervision and introduce external supervision from lawyers to ensure the legitimacy of the suggestion system.And it is also necessary to promote legislation to achieve convergence between different laws,and screen the legal effect of leniency suggestions from supervisory organs,denying suggestions with illegal contents or breach of procedure.Since the convergence between different laws has not been achieved,the standard of leniency and procedure for transferring should be refined to guarantee the operability of the system.
