人工智能时代法律职业的变迁与法学教育变革

以大数据为基础的人工智能技术发展,将人类卷入了人工智能时代,对人类经济、社会和文化产生深远影响。人工智能时代,伴随着人工智能技术在法律职业中日益广泛的运用,法官、律师等法律职业都面临着机遇与挑战。一方面,借助于人工智能技术,法律工作者得以从重复性的工作中解放出来,专注于更具创造性和挑战性的工作;另一方面,大量简单、重复的法律职业将被法律机器人逐渐替代。传统法学教育在教育目标、教学内容、教学方法等方面存在问题,难以适应人工智能时代的现实需求。面对人工智能时代,法学教育宜在教育目标、教学内容和教学方法上加以变革。在教育目标上,宜坚持专业教育和人文素质、情感教学相结合;在教学内容和法学专业设置上,宜合理更新教学内容和法学专业设置;在教学方法上,宜创新法学教育方法,合理运用人工智能技术,改善教学效果,努力实现法学教育的智能转型,以回应人工智能时代的现实需求。

The development of artificial intelligence based on big data has brought human beings into the age of artificial intelligence,which has a profound impact on human economy,society and culture.In the age of artificial intelligence,along with the increasingly widespread application of artificial intelligence in the legal profession,judges,lawyers and other legal professions are facing opportunities and challenges.On the one hand,with the help of artificial intelligence,lawyers can be liberated from repetitive work,focusing on more creative and challenging work.On the other hand,a large number of simple and repetitive legal duties will be replaced by AI lawyer.There are some problems in traditional law education,such as biased educational objectives,outdated teaching contents and teaching methods,which make it difficult to meet the practical needs in era of artificial intelligence.In the age of artificial intelligence,law education should be reformed in educational objectives,teaching contents and teaching methods.In terms of educational objectives,we should adhere to the combination of professional education,humanistic quality and emotional teaching.In terms of teaching content and legal specialty setting,we should update the teaching content and legal specialty setting rationally.In terms of teaching methods,we should innovate legal education methods,rationally use artificial intelligence technology,improve teaching effect,and strive to realize the intelligent transformation of legal education to respond to the realistic demand of the age of artificial intelligent.
