日本法学教育中的研讨课制度及其对我国的启示 被引量:2

摘要 研讨式教学法日益受到我国法学教育界的关注和青睐,但实施效果却不尽如人意。日本法学教育中的研讨课制度是针对法学教育与法律人才选拔机制的脱节现象而提出的一项改善策略,其强调学生的主体参与和师生间的双向互动,从而使法律思维和法律技能的教育成为可能,该制度的实施是对"大教室讲义"教学的补充和升华。在我国的法学教育体系下开展研讨式教学,应充分借鉴日本的研讨课制度,明确研讨式教学的目标是职业技能教育,研讨式教学的具体内容是智能技能教育,研讨式教学只是本科法学教学的一部分。 The seminar-based teaching method is increasingly favored by law teaching in China,but the effect is not satisfactory.Seminar teaching in Japanese legal education is proposed for eliminating the disconnection between legal education and legal talent selection mechanism.It emphasizes the subjective participation of students and the two-way interaction between teachers and students,which makes the education of legal thinking and legal skills possible.The implementation of seminar-based teaching would be the supplement and sublimation of the“big classroom lecture”teaching.Chinese legal education should fully draw on the seminar teaching of Japan,clarify that the goal of seminar-based teaching is legal professional skills education,the content of seminar-based teaching is intelligent skill education,seminar-based teaching is only part of the undergraduate law teaching.
