民族地区双语法律人才队伍建设研究--基于S省A民族自治州基层法院调研

Research on the Construction of Bilingual Talents Team in Ethnic Area:An Empirical Analysis of Grassroots Courts in Ethnic Autonomous Region A of Province S

《中华人民共和国宪法》及诸多相关法律均赋予少数民族公民使用本民族语言参与诉讼的权利,因此双语法律人才是该权利在诉讼中得以落实的重要保障。目前,我国在双语法官培训上取得了一定成就,但并未完全化解实践中存在的诸多不足。S省A民族自治州基层法院相关问题的调研资料说明:(1)应合理利用法院双语法律人才,畅通双语法官流入通道;(2)扩大双语培训对象范围,有针对性地开展培训工作;(3)建立翻译人才库,统一管理培训;(4)完善翻译人员管理制度。

China's Constitution and other relevant laws have granted ethnic minorities the right to use their own languages in lawsuits,in which bilingual talents are an important guarantee.For the past few years,China has made several achievements in training bilingual judges,yet there are still some practical issues unresolved.Drawing on empirical data collected in grassroots courts in Ethnic Autonomous Region A of Province S,this research concludes that:(1)it is significant to make rational use of bilingual talents in courts and ensure that the influx of bilingual judges is unimpeded;(2)the scope of bilingual training should be expanded and the training work should be carried out in a systematic manner;(3)it is essential to set up a talent pool for interpreters and manage them in a unified way;(4)the administration system for bilingual interpreters needs to be improved.
