论新时代监察体制改革背景下检察权的完善与发展

Improvement and Development of Prosecutorial Power under the Background of Supervision System Reform in the New Era

监察体制改革后,检察机关的职务犯罪侦查权由监察委行使,检察机关享有的检察权也随之面临着调整。检察权的调整完善目前依然存在一些问题,比如检察机关是否需要对监察委行使的职务犯罪侦查权进行监督、检察机关仍然保留的公诉权和检察监督权是否需要进一步改进等。通过探索域内外检察权随政治需要、职能变化和机构改革而不断发展变化的演进脉络,可以从权力分化和权力的协调与平衡的角度思考我国检察权的完善思路。完善措施具体为:在监察机关行使职务犯罪侦查权初期就进行监督,设立相应的监督部门;在完善公诉权方面,借鉴外国的辩诉协议制度完善监察制度与刑事诉讼制度的衔接;在完善检察监督权方面,强化检察机关的法律监督权,发展和完善行政公益诉讼制度。

After the supervision system reform,the procuratorial organ’s right to investigate duty crimes is exercised by the supervisory committee,and the procuratorial power enjoyed by the procuratorial organs is also facing adjustment.At present,there are still some problems in the adjustment and improvement of the procuratorial power,such as whether the procuratorial organ needs to supervise the investigation power of duty crimes exercised by the supervision committee,whether the procuratorial organ still retains the public prosecution power and procuratorial supervision power need to be further improved.By exploring the evolution of procuratorial power at home and abroad with the political needs,functional changes and institutional reform,we can think about the improvement of procuratorial power in China from the perspective of power differentiation,power coordination and balance.The measures to improve the procuratorial power are as follows:set up corresponding supervision departments and supervise at the early stage of the supervision organ exercising the power of investigation on duty crimes;in the aspect of improving the public prosecution power,learn from the foreign plea agreement system to improve the connection between the supervision system and the criminal litigation system;in the aspect of improving the procuratorial supervision power,strengthen the legal supervision power of the procuratorial organ,develop and improve the administrative public interest litigation system.
