论民间法的法治中国担当——一种法哲学视角

On the Legal Function of Folk Law:Based on the Perspective of Legal Philosophy

一般意义上法治的本真状态是让被视之为“法”的规范都具有其应有的“法”之地位。法治秩序的复数外延形态意味着,法治具有场域层次性。法治的场域层次性表明,民间法像国家法一样,亦有其法治使命担当。基于场域层次性或场域公共秩序逻辑,民间法的法治使命担当主要展现为两方面。一方面,“治未病”,在国家法还没开始“操心”之前解决现实生活纠纷,回复整个社会法秩序;另一方面,配合国家法,实现整个社会法秩序回复的完整性,在国家法回复政治秩序的时候,民间法回复国家范围内不同区域或领域亦即各种场域法域的场域公共秩序。

The rule of law is to let the law has its due legal status.The various levels in the leagal order mean that the rule of law has its field levels.Field levels in the rule of law shows that folk law,like state law,also has its legal mission.Based on the field levels or the logic of field public order,the legal mission of folk law is mainly manifested in two aspects.On the one hand,before state law begins to perform its duties,folk law solves the real life disputes and restores the whole social law order.On the other hand,folk law cooperates with state law to restore the whole social law order,that is,when state law restores the political order,folk law restores the public order in different regions or fields within the state.
