新媒体视域下的平等权保护——对网络仇恨言论的反思

随着网络信息技术的快速发展,新媒体正以一种悄然而迅猛的方式渗透于我们的日常生活。新媒体中网络仇恨言论的肆虐给平等权保护带来危机,包括不平等的深化、仇恨言论识别危机和平等权保护模式危机。危机出现的根源在于新媒体背景下"第四权力"的扩张,导致传统权力格局发生变迁。为了应对仇恨言论对平等权侵害、破解新媒体歧视谜题,对新媒体自身特点与法律内部进行剖析,推动新媒体时代法律的自觉型发展以规制网络仇恨言论、保障平等权就显得尤为重要。通过个体的自我学习与借鉴加拿大的奥克斯标准识别网络仇恨言论,同时采用技术监管、教育与法律结合的多重保护,把握言论自由与平等权保护之间的平衡。

With the rapid development of network information technology,new media is infiltrating our daily lives in a quiet but rapid way.The spread of hate speech in the new media has brought crises to the protection of equal rights,including the deepening of inequality,the crisis of recognition of hate speech,and the crisis of protection of the right to equality.The root of the emergence of the crisis is the expansion of the"the fourth power"in the context of new media,leading to changes in the traditional power structure.In order to cope with the infringement of hate speech on the right to equality and solve the mystery of discrimination in new media,it is important to study the characteristics of the new media and the internal laws to promote the conscious development of the law in the new media era to regulate online hate speech and protect the right to equality.Identifies online hate speech through individual self-learning and learning from Canada's Oakes standard.At the same time,it adopts multiple protections combining technical supervision,education and law to grasp the balance between freedom of speech and protection of equal rights.
