行政规范性文件俗称"红头文件",一般是指各级各类行政机关为实施法律、执行政策所制定的除行政法规和规章以外的具有普遍约束力的决定、命令及行政措施,是抽象行政行为的重要组成部分。在"湖南省常德市金泽置业有限公司等欠缴土地出让金公益诉讼"一案中,常德市人民检察院对市住建局制定的行政规范性文件提出检察建议。在行政公益诉讼之中,检察机关可否针对行政规范性文件提出检察建议?检察建议的适用范围是哪些?检察机关针对行政规范性文件提出检察建议存在哪些问题?亟待对此等问题进行简要探讨。

Administrative regulatory documents,commonly known as "red head documents",generally referring to the decisions,orders and administrative measures with general binding force other than administrative regulations and rules formulated by various administrative organs at all levels to implement laws and policies. They are important parts of abstract administrative actions. In the case of "public interest litigation on the Hunan Province Changde City Real estate Co. Ltd,which defaulted payment land transferring fees ",the People ’ s Procuratorate of Changde City putting forward suggestions on the administrative regulatory documents formulated by the municipal bureau of Housing and Construction. In administrative public interest litigation,can the prosecutors make procuratorial Suggestions on administrative regulatory documents?What is the range of application of the inspection proposal? What problems do the prosecutors have in making procuratorial suggestions on administrative regulatory documents? This paper will discusse these problems briefly.
