微信群抢红包赌博的罪名界定标准探析

Analyze Criteria of Defining the Crime of Gambling by Grabbing Red Envelopes through WeChat Group

目前,微信群抢红包赌博犯罪日益猖獗,加之开设赌场与聚众赌博行为相似,刑法规制陷入了开设赌场罪与赌博罪的界定困境。"赌场"仅指赌博的场所,是开设赌场和聚众赌博的行为载体,网络"赌场"不限于赌博网站,所有能进行赌博活动的网络空间均在其列。有输赢之分的微信群抢红包行为属于赌博行为。"以营利为目的"是开设赌场罪与赌博罪的必备要素,不能作为两罪的区分条件。管理性标准是区分聚众赌博与开设赌场性质的关键,以管理赌场的运营规则、赌场人员的具体分工、赌场的持续经营三个要件综合判定。行为人带有营利目的,于微信群抢红包赌博,符合管理性标准,应定性为开设赌场罪,不应认定为赌博罪。

Nowadays,the crime of gambling by grabbing red envelopes through WeChat groups has become increasingly prevalent.Moreover,the establishment of casinos is similar to group gambling,but legislators are in a plight of making laws or regulations to separate them."Casino"only refers to a gambling place.The establishment of a casino is only a behavior carrier of group gambling;Internet"casinos"are not limited to gambling web sites,which includes whole gambling cyberspace.If it is related with winning or losing,snatching red envelopes through WeChat groups belongs to gambling."Seeking profit"is an essential element of the crime of setting up a casino and gambling,which cannot be used as a condition for distinguishing the two crimes.The criterion of manageability is the key to defining group gambling and establishing a casino which can be generally judged by three elements of casino operation management rules,casino personnel’s specific job assignments and casino continuous operation.The actor has a profit-seeking purpose,and gambling by grabbing red envelopes through WeChat groups meets the management standard,which should be classified as the crime of opening casinos but not the crime of gambling.
